AGREEMENT OR RELEASE AND WAIVER OF LIABILITY

 

I, _________________________________, hereby agree to the following:

1. That I am employing Bartender’s Direct, LLC to cater my _______________, during which time, Bartenders Direct will provide bartenders to serve my __________________ (client, customers, other, etc.). I recognize that it is possible that I may be held liable for the acts, or omissions of my clients as a result of serving alcohol to said clients, customers, etc. Therefore, I am fully aware of the risks and hazards involved.

2. I have been offered the opportunity to purchase liability insurance through Bartender’s Direct, LLC to protect/insure myself and/or my establishment from liability for the acts or omissions of my clients, customers, etc. after having been served liquor in my home, business, establishment, etc.

3. Liability shall have the following meaning: Liability means all claims, damages, liability, losses, costs and expenses, court costs and reasonable attorneys' fees, including attorneys’’ fees incurred by the above name.

4. That my initial on this line indicate that I have turned down said liability insurance. [_______]

5. In having so turned down said liability insurance, I agree to assume full responsibility/liability for any risks, injuries or damages, known or unknown, which I might incur as a result of serving alcoholic beverages in my home and/or establishment.

6. In consideration of having Bartender’s Direct, LLC or its employees cater my event, I knowingly and expressly waive any claims that I may have against Bartender’s Direct, LLC or its employees for claims against me, my home, my establishment, my business, etc. for my waiver of liability insurance.

7. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Bartender’s Direct, LLC , or its employees for any liability that I, home, my establishment, or business may sustain as a result of not purchasing said insurance.
